These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and FinForm LLC ("FinForm," "Company," "we," "us," or "our").
1. Acceptance of Terms
By visiting our website ("Platform"), purchasing or accessing any product or service, or participating in our programs, you confirm that you have read, understood, and agree to these Terms.
If you do not agree to these Terms, please do not access or use our services.
2. Nature of Services (IMPORTANT - PLEASE READ)
FinForm provides financial education services only. All services are provided for educational and informational purposes only. FinForm does NOT provide investment advice, financial planning, legal advice, or tax advice. FinForm does not act as a registered investment advisor, broker-dealer, or fiduciary. No professional-client relationship is created. All information is general and educational in nature. If an Independent Educator provides any information or advice that exceeds the scope of educational content, that conduct is outside the scope of FinForm's services, FinForm bears no liability for it, and the User's sole recourse is against the Independent Educator directly.
3. No-Advisor-Client Relationship
Use of the Platform does NOT create any fiduciary or advisor-client relationship. All interactions are strictly educational.
4. Platform Role & Independent Contractors
FinForm serves as a technology platform connecting Users with Independent Educators. Independent Educators are not employees, agents, or representatives of FinForm. FinForm does not control, supervise, or direct the specific manner, means, or methods by which Independent Educators provide their services, especially within the specified times of their meetings.
5. Platform Changes
To keep our programs relevant and effective, FinForm may migrate platforms or change delivery methods of services.
We aim to ensure that any changes do not materially reduce the overall educational value of your purchase, and we will provide substantially similar access where reasonably possible.
6. No Guarantees or Outcomes
FinForm does not guarantee outcomes or session quality. We believe deeply in the value of financial education, but FinForm makes no guarantees regarding financial results, income, wealth accumulation, investment performance, or personal outcomes. Past results, testimonials, or examples are not guarantees of future results. Any customer testimonials or success stories displayed on the platform are individual experiences and not representative of typical outcomes.
7. User Responsibility & Assumption of Risk
Users are solely responsible for their financial decisions and assume all risks associated with using information from the Platform.
8. Payments, Cancellations & Refunds
Users agree to pay all fees. Cancellations made more than 24 hours in advance may be refunded. Late cancellations (24 hours or less) are non-refundable. Missed sessions are not refunded. All prices are listed in U.S. dollars unless otherwise stated. Payment must be completed before access is granted. Accepted payment methods are disclosed at checkout.
Any sale is considered final once the session is 24 hours or less away from the scheduled time.
That said, we care deeply about our customers and their experience. If you believe your situation deserves special consideration, you may submit a written refund request within thirty (30) days of purchase. Each request is reviewed individually and at FinForm's sole discretion.
If approved, a refund may include administrative or processing fees. We reserve the right to deny refund requests that fall outside these guidelines or reflect abuse of the refund process.

9. Session Disclaimer
All sessions are provided AS-IS and AS-AVAILABLE, without any express or implied warranties. FinForm does not warrant the accuracy, completeness, or fitness for the purpose of any educational content delivered.
10. User Conduct
Users must provide accurate information and use the platform lawfully. Sessions may be terminated without refund at FinForm's discretion for, but not limited to, the following prohibited conduct: harassment of Independent Educators, fraudulent bookings, attempting to obtain regulated advice, sharing session access links, recording sessions without consent, or misuse of the Platform.
11. Intellectual Property
All Platform content is owned by FinForm and protected by law.
12. Privacy & Data Use
Use of the platform is governed by our Privacy Policy. Our Privacy Policy explains how we collect, use, store, and disclose personal information and describes your privacy rights. Please review our privacy policy here.
13. Confidentiality
The parties agree to maintain the confidentiality of any non-public, proprietary information shared during the course of the services, including but not limited to financial, business, and personal information. This obligation survives termination of these Terms.
14. Limitation of Liability
FinForm is not liable for financial losses. To the maximum extent permitted by law, FinForm's total liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim, EXCEPT FOR liability arising from FinForm's gross negligence, willful misconduct, fraud, or for death or personal injury caused by FinForm. We are not liable for any indirect, incidental, special, consequential, punitive or exemplary damages.
15. Indemnification
You agree to indemnify and hold harmless FinForm, its officers, directors, employees and agents from any and all claims, losses, or expenses (including attorney's fees) arising from your use of the services or violation of these Terms.
16. Modifications to Service
FinForm may modify or discontinue services at any time.
17. Dispute Resolution
Before initiating arbitration, both parties agree to attempt informal resolution for a period of thirty (30) days.
To initiate this, a party must send a written notice to support@finform.org that includes a description of the dispute and the desired resolution.
If unresolved, disputes will be resolved through binding arbitration administered by the American Arbitration Association, conducted individually in Virginia, under the Federal Arbitration Act. Class actions are waived.
The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.
18. Updates to Terms
FinForm may update these Terms at any time by posting the revised Terms on the Platform. Continued use of the services after the updated Terms are posted constitutes acceptance of such updates.
19. Governing Law
These Terms are governed by the laws of the State of Virginia, without regard to conflict-of-law principles.
20. Force Majeure
FinForm is not liable for delays or failures caused by events beyond reasonable control, including natural disasters, pandemics, platform outages, or governmental actions.
21. SMS Communications
By providing your phone number, you consent to receive transactional and promotional SMS messages from FinForm. Message frequency will vary. Message and data rates may apply. You may opt out at any time by replying STOP to any message. For help or information, reply HELP or contact us at support@finform.org.
22. Entire Agreement
These Terms constitute the entire agreement between you and FinForm and supersede all prior agreements. No separate signature is required.
23. Assignment
You may not assign these Terms without consent. FinForm may assign freely.
24. Survival
Provisions relating to intellectual property, confidentiality, liability, indemnification, dispute resolution, and governing law survive termination.
25. Severability & Waiver
If any provision is unenforceable, the remainder remains effective. Waivers must be in writing.
